Terms of Use
These terms apply when you download or use the Chie app for iPhone and its Share extension (“Chie”). Chie is made by NIXA Inc. (“NIXA”, “we”, “us”). By using Chie, you agree to these terms.
In plain words
- Chie is a private place on your iPhone to save things and find them again.
- What you save is yours and stays on your device. We never see it, so please keep a backup; we can’t recover it for you.
- Automatic features such as text reading, photo descriptions, link previews and Today in history can be wrong.
- Chie is free today. If we ever charge for something, the App Store will show the price before you pay.
1. What Chie is
Chie lets you save text, web links, photos, screenshots and PDFs, add your own notes, and search and revisit them later. It runs on your iPhone and works without an account. Chie is available only on Apple devices that run a supported version of iOS, and some features need specific hardware or settings (for example, photo descriptions need an iPhone with Apple Intelligence turned on).
2. Your license to use Chie
NIXA grants you a personal, non-exclusive, non-transferable, revocable license to use Chie on Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms and Conditions. You may not copy, modify, reverse engineer, resell or distribute Chie except where the law allows it despite this restriction.
3. Your content
- It’s yours. You keep all rights to what you save in Chie, including your notes. Because your content stays on your device, you do not give NIXA any license to it.
- Your responsibility. Only save content you have the right to keep, and respect other people’s privacy and rights, including copyright, when you save or share their material.
- Backups are up to you. NIXA does not hold a copy of your library. If you lose or reset your iPhone, delete Chie, or turn off backups, your memories may be lost. Chie offers iCloud backup and file export to help; you are responsible for using them.
4. Automatic features
Chie reads text in your photos and PDFs, can describe your photos, fetches previews of links you save, and suggests historical events from Wikipedia that may match your interests. These features are automatic and can be incomplete or wrong. Don’t rely on them for important decisions. Historical events come from Wikipedia, whose text is available under the Creative Commons Attribution-ShareAlike license; Chie shows them as Wikipedia wrote them and links to the source.
5. Links and other services
Saved links open websites that NIXA does not control, and a saved link is not a copy of that page. Features that use Apple services, including iCloud, Apple Intelligence, Face ID and Touch ID, are provided by Apple under Apple’s terms. NIXA is not responsible for third-party websites or services, or for content that is unavailable when you return to it.
6. Acceptable use
Don’t use Chie to break the law, to infringe anyone’s rights, or to interfere with Chie, the Share extension, or the services it connects to, for example by attempting to bypass its security or overload a website through link previews.
7. Privacy
Our Privacy Policy explains how Chie handles information. In short: your memories stay on your device, we never sell your information, and Chie contains no advertising or tracking.
8. Price and changes
Chie is currently free. If we offer paid features in the future, they will be sold through the App Store under Apple’s payment terms, with the price shown before you buy. We may update Chie, add or remove features, or stop offering it. If we stop offering Chie, the version on your iPhone will keep your memories and its export, so you can keep your library.
9. Ending these terms
You can stop using Chie at any time by deleting it. These terms end automatically if you break them, and you must then stop using Chie. Sections 3, 10, 11, 12 and 14 continue to apply after these terms end.
10. Disclaimer
Chie is provided “as is” and “as available”. To the fullest extent the law allows, NIXA disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that Chie will be error-free or uninterrupted, or that its automatic features will be accurate.
11. Limitation of liability
To the fullest extent the law allows, NIXA will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, content or memories, arising from your use of Chie. NIXA’s total liability for any claim relating to Chie will not exceed the greater of the amount you paid for Chie in the twelve months before the claim, or US $50. Some places don’t allow these limits, so they may not apply to you, and nothing in these terms limits rights you have under consumer protection law.
12. Apple and the App Store
These terms are between you and NIXA only, not with Apple Inc. (“Apple”). In addition:
- NIXA, not Apple, is solely responsible for Chie and its content.
- Apple has no obligation to provide maintenance or support for Chie. Questions and support go to NIXA at beta@chie.house.
- If Chie fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, that you paid for Chie. To the maximum extent the law allows, Apple has no other warranty obligation for Chie, and any other claims, losses, liabilities, damages, costs or expenses from a failure to meet a warranty are NIXA’s responsibility, subject to these terms.
- NIXA, not Apple, is responsible for addressing any claims by you or a third party relating to Chie or your use of it, including product liability claims, claims that Chie fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that Chie or your use of it infringes their intellectual property rights, NIXA, not Apple, is responsible for the investigation, defense, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using Chie.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, Apple may enforce them against you as a third-party beneficiary.
13. Changes to these terms
We may update these terms as Chie changes. We will update the version date and, for material changes, tell you in the app or on this site before they take effect. If you keep using Chie after a change, the updated terms apply.
14. Governing law
These terms are governed by the laws of the State of North Carolina and applicable United States federal law, without regard to conflict-of-law rules, except where the consumer protection laws of the place you live require otherwise.
